Terms of Service

These terms are an agreement between Purplematics Technologies OPC Pvt Ltd ("Engagetic", "we") and the business accepting them ("you"). By creating an account or using the platform, you accept these terms on behalf of your business and confirm you have authority to do so.

1. The service

Engagetic provides an AI engagement platform: WhatsApp marketing campaigns, AI agents that respond to conversations, a shared team inbox with human handover, and related tools. Features marked "coming soon" are not part of the service until released. We may improve or modify the service; we will not materially reduce core functionality you have paid for during a paid term without notice.

2. Your account

Keep your credentials secure; you are responsible for activity under your account. Provide accurate information and keep it current.

3. WhatsApp — your obligations

WhatsApp messaging is delivered via the WhatsApp Business Platform and is subject to Meta's WhatsApp Business Terms, Business Messaging Policy, and Commerce Policy. You must:

• Obtain and record valid opt-in consent from every contact before sending them marketing messages, in the manner WhatsApp's policies require, and honour opt-outs immediately.
• Send only content permitted by WhatsApp's policies — no prohibited goods or services, no deceptive, harassing, or illegal content.
• Use approved message templates where WhatsApp requires them and respect messaging windows.
• Upload only contact lists you have the legal right to message.

You are solely responsible for your compliance with these policies and with marketing, privacy, and spam laws in the places you message people. If Meta restricts or bans your WhatsApp number for policy violations, that is between you and Meta; we may suspend the affected functionality.

4. Acceptable use

Do not use Engagetic to send spam or unconsented marketing; break the law; infringe others' rights; distribute malware; harass or defraud; probe or disrupt the service; or resell the service without our written agreement (agency and white-label use is permitted under your plan's terms). We may suspend accounts that put the platform, other customers, or our WhatsApp relationship at risk, and will tell you why unless the law prevents it.

5. AI features

AI-generated replies are produced automatically and can be wrong. You are responsible for the configuration of your AI agent, for reviewing its behaviour, and for what it sends on your behalf. Do not rely on AI output for legal, medical, or financial advice to your customers without human review.

6. Your data

You retain all rights to your data — contact lists, conversations, and content. You grant us the licence needed to operate the service on your instructions (process, store, transmit, display). We handle personal data as described in the Privacy Policy and, where applicable, a data processing agreement available on request.

7. Fees

Paid plans are billed in advance as described at purchase. Fees are non-refundable except where the law requires otherwise. WhatsApp conversation charges set by Meta may be passed through as described in your plan. We may change prices with notice effective from your next billing period.

8. Intellectual property

The platform, its software, and its branding are ours. Feedback you give us may be used without obligation.

9. Disclaimers

The service is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation, delivery of any particular message, or any specific business result, and we make no warranty for WhatsApp platform behaviour, which is controlled by Meta.

10. Liability

To the maximum extent the law allows: neither party is liable for indirect, incidental, or consequential loss, or lost profits or data; and our total liability under these terms is capped at the fees you paid us in the 12 months before the claim. Nothing limits liability that cannot lawfully be limited.

11. Indemnity

You will defend and indemnify us against third-party claims arising from your content, your contact lists, your breach of WhatsApp's policies, or your violation of law.

12. Termination

You may cancel at any time, effective at the end of the paid period. We may terminate for material breach with notice, or immediately for serious abuse. On termination, your data is available for export for 30 days, after which it is deleted per the Privacy Policy.

13. General

These terms are governed by the laws of Tamilnadu- India, and disputes belong to its courts. If a clause is unenforceable, the rest stands. These terms plus your order are the whole agreement. Engagetic is not affiliated with Meta Platforms, Inc.; "WhatsApp" is a trademark of Meta.
